  • These terms of service agreement ( agreement or terms and conditions) is a legal agreement between you (you requester or customer) and Snapmob.io a product of white village digital, a california based company ( Snapmob.io , we, us, our, etc.), the owner and operator of the Snapmob.io mobile application(s) (the mobile application or applications ) and the related website, https://www. Snapmob.io (the site). The mobile applications and the site may hereinafter be referred to collectively as the platform. This agreement states the terms and conditions that govern your use of the applications, the site, all services, features, and resources available or enabled via the applications and the site (collectively, with the mobile applications, the services), and your purchase of goods or services of snapmob.

  • Welcome to Snapmob.io and white village digital company this application (from here on app and/or services) is provided solely to offer and facilitate a business exchange between photographers and customers for photoshoot services from photographers near you. The use of this app and our services, is subject to the full acceptance of all the terms, conditions, privacy policy and notices set forth below (from here on collectively, the agreement). By downloading, accessing or using this application in any way or manner, you agree to be bound by the agreement and represent that you have read and understood all these terms. Please read the agreement carefully, as it contains information concerning your legal rights and limitations on these rights, as well as a section regarding applicable law and jurisdiction of disputes. We may change or otherwise modify the agreement in the future, and you understand and agree that your continued access or use of this application after such change signifies your acceptance of the updated or modified agreement. We will note the date that revisions were last made to the agreement at the bottom of this page, and any revisions will take effect upon posting. We will notify our members of material changes to these terms and conditions by either sending a notice to the email address provided to us at registration or by placing a notice on our application. Be sure to return to this page periodically to review the most current version of the agreement. Any user, member, registered member, person or company agrees that by using or joining Snapmob.io and white village digital company via the app or any access via the internet, are entering into a legal binding contract; otherwise if you do not accept all these terms and conditions, please do not use this app or registry.

  • By accessing and using any of the services, you are indicating that you accept, and agree to comply with, this agreement and the stripe connected account agreement.

  • If you do not accept this agreement, you are not permitted to, and you must not, access or use the services or purchase products or services from snapmob.

  • Please be advised that this agreement contains provisions that govern how disputes between customers and Snapmob.io are resolved, which include a jury trial waiver and a class action waiver.

  • Definitions

    Capitalized terms used herein shall have the respective meaning ascribed to them in the sentence or phrase in which such term is first used in this agreement. For purposes of this agreement, the term user, you and customer shall apply to all individuals accessing the platform for any reason whatsoever, whereas the term requester shall solely apply to those users that request a transaction for photography on the platform but shall not supersede or replace the terms of this agreement to the extent that any terms referring to a user conflict with those terms only applicable to a requester.

  • Agreement

    Use of site. Snapmob.io may add to, change or remove any part of the mobile applications or the site, including, without limitation, any content, information, text, images, graphics, interfaces, audio and video clips and any other materials displayed through the services (collectively, the content) therein, at any time without prior notice to you.
    Third-party payment servicer. payment processing services for users on the mobile application are provided by stripe and are subject to the stripe connected account agreement, which includes the stripe terms of service (collectively, the stripe services agreement). By agreeing to these terms and conditions or continuing to operate as a user on the applications, you agree to be bound by the stripe services agreement, as the same may be modified by stripe from time to time. as a condition of Snapmob.io enabling payment processing services through stripe, you agree to provide Snapmob.io accurate and complete information about you and your business, and you authorize Snapmob.io to share it and transaction information related to your use of the payment processing services provided by stripe.

  • Use of the mobile application and the services

    This section shall apply to the user s utilization of the snapmob.io self service mobile application ios application or snapmob.io self service android application. The applicability of the terms and conditions stated in this agreement is contingent on the users downloading of the mobile application or utilization of the applications, sites and services by user and shall apply immediately at time of access. Further, if the user accesses the snapmob.io services on an android device the android terms shall apply and if the user accesses the snapmob.io services on an apple device the ios terms shall apply. For purposes of this section and to the extent applicable in this agreement, the ios application and android application will be referred to collectively as applications or mobile applications.

  • End-user license for apple application

    Subject to these terms and conditions, snapmob.io grants the user a personal, non-exclusive, non-transferable, limited and revocable license to use the mobile applications for personal use only on an apple iphone, ipad, or ipod touch ( ios device) owned or controlled by user as permitted by the usage rules contained in the apple terms and in accordance with these terms and conditions ( apple user license). Any use of the ios device in any other manner, including, without limitation, resale, transfer, modification or distribution of the ios application or text, pictures, music, barcodes, video, data, hyperlinks, displays, and other content associated with the ios application is prohibited. This agreement and apple user license also governs any updates to, or supplements or replacements for, the ios application unless separate terms accompany such updates, supplements or replacements, in which case the separate terms will apply.

  • Incorporation of related android terms

    These terms and conditions incorporate and supplement the google, inc. Android ( android) market terms of service (available at http://www.google.com/mobile/adroid/market-tos) and the google play developer distribution agreement (available at https://play.google.com/about/developer-distribution-agreement. showlanguages), ( android terms). In addition, these terms and conditions also incorporate and supplement other terms, conditions, and policies of snapmob.io posted at http://www.snapmob.com, including without limitation the disclaimer, the privacy policy, and other policies, the location and terms of which may be changed from time-to-time. Should any provisions in the terms, conditions, or other policies listed above conflict with these terms and conditions, these terms and conditions will control, solely to the extent such provisions apply to the application.

  • End-user license for android application.

    Subject to these terms and conditions, snapmob.io grants the user a personal, non-exclusive, non-transferable, limited and revocable license to use the mobile applications for personal use only on an android device owned or controlled by user as permitted by the usage rules contained in the android terms and in accordance with these terms and conditions ( android user license). Any use of the android application in any other manner, including, without limitation, resale, transfer, modification or distribution of the android application or text, pictures, music, barcodes, video, data, hyperlinks, displays, and other content associated with the android application is prohibited. This agreement and android user license also governs any updates to, or supplements or replacements for, the android application unless separate terms accompany such updates, supplements or replacements, in which case the separate terms will apply.

  • User information

    Services and features, such as the mobile applications may use, maintain, or transmit user s personal information, including, without limitation, user names, passwords, proper names, email address, address, location, financial information (including payment method information), gps location information, and information for and from third-party social-media accounts (collectively user information). By acknowledging and agreeing to this agreement, or by using the mobile applications, site, or other services, user consents to the transmission of user information to snapmob, including its agents and third-party partners, and consents to snapmob, including its agents and third-party partners, receiving, collecting, storing, processing, transmitting, and using user information for mobile application functionality and for the purposes disclosed in one or more of the snapmob.io policies identified in this agreement.
    Obligations of use of the app and website as a condition of your use of this app or services, you warrant and agree that:
    (i) all information supplied by you on this application is true, accurate, current and complete,
    (ii) if you have a snapmob.io app account, you will safeguard your account information, including your access password and keep it confidential and will supervise and be completely responsible for any use of your account by anyone other than yourself and
    (iii) you are 12 years of age or older in order to register for an account and contribute to our website. snapmob.io and white village digital company does not knowingly collect the information of anyone under the age of 18.
    We retain the right at our sole discretion to deny access to anyone to this website and the services we offer, at any time and for any reason, including, but not limited to, for violation of this agreement.Payment in the case you decide to acquire our premium services, you agree to pay us the applicable fees and taxes and to additional terms specific to the paid services. in the case you should not pay any of the items detailed, it will result in the termination of your paid services.
    All users agree to make the appropriate payment prescribed directly on the mobile app according to premium service agreement and individual transactions users recognize that snapmob.io and white village digital and other third party billing agencies will receive a portion of the overall transaction. This percentage will not exceed the amount identified in the signup of the app users. questions regarding fees received from individual transactions should be directed to info@ snapmob.io attention transaction fees. prices, fees and billing. upon registration you will be required to provide snapmob.io with information regarding your credit card or other payment instrument. You represent and warrant to snapmob.io that such information is true and that you are authorized to use the payment instrument. You will promptly update your account information with any changes (for example, a change in your billing address or credit card expiration date) that may occur. You agree to pay snapmob. iocharges incurred in accordance with these terms and conditions. You hereby authorize snapmob.io to bill your payment instrument in accordance with these terms and conditions until you terminate your account, and you further agree to pay any charges so incurred. If you dispute any charges you must let snapmob.io know within thirty (30) days after the date services are requested. You shall be responsible for all taxes associated with the use of the application other than u.s. taxes based on snapmob net income (e.g., sales tax). cancellation, refund policy. refunds will be made on a case-by-case basis. Due to the nature of the mobile application users will consider all sales final.

  • Not experts.

    Requestor understands that the users that perform the services for you are not experts in any field, and neither possess nor apply any special or specific skill, knowledge, or expertise to their observations and transaction, and further acknowledge that your personal observations and opinions might differ from those contained in your transaction. The photographs contained in your transaction may differ from photographs that would be taken by a professional photographer. As a customer you may ask a user to demonstrate that the subject matter being document is in basic working order if doing so is reasonably practicable for the user. The user may accept or deny such supplementary request in user s sole discretion. The user is not an expert, and will not perform any diagnostic tests. User shall have the discretion to demonstrate only the most basic functions of the subject matter that is being documented. Unless otherwise agreed to in writing as a part of your order and approved by snapmob, requester shall not expect a user to demonstrate each function or any specific feature of the subject matter being documented. use of information the content and information on our snapmob.io (including, but not limited to, messages, data, information, text, music, sound, photos, graphics, video, maps, icons, software, code or any other material), as well as the infrastructure used to provide such content and information, is proprietary to snapmob,io and white village digital. You agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through this application. However any information posted by you on our service (that is not included in the first and second sentence of this section 5) is yours, but by using our service you are only granting snapmob.io and white village digital company the following non-exclusive license: a worldwide, transferable and sublicensable right to use, copy, modify, distribute, publish, and process, information and content that you provide through our services, without any further consent, notice and/or compensation to you or others. When you use third party services that use, or are integrated with, our services, they may receive information about what you post or share.

  • Prohibited User:

    (i) use this application or its contents for any commercial purpose;
    (ii) access, monitor or copy any content or information of this website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
    (iii) violate the restrictions in any robot exclusion headers on this application or bypass or circumvent other measures employed to prevent or limit access to this application;
    (iv) take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;
    (v) deep-link to any portion of this application for any purpose without our express written permission; or
    (vi) \"frame\", \"mirror\" or otherwise incorporate any part of this application into any other website without our prior written authorization;
    (vii) attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by snapmob.io and white village digital company in connection with the application or the services; and,
    (viii) post any sexually explicit content like pornography or any nudity of any kind, even if it were authorized by the user. Content posted containing of any sexual fetishism content will be removed. individually, any user will be liable subject to legal action, from snapmob.io or white village digital it's users or third parties for their own actions and posted content. snapmob.io and white village digital company will not be liable to you or others for any indirect, incidental, special, consequential or punitive damages, or any loss of data, opportunities, reputation, profits or revenues, related to the services of actions of its users of any kind (for example, ratings or any comments), but will take swift measures to ensure the fulfillment of rights, laws and international treaties. snapmob.io reserves the right, in its sole discretion, to terminate any user license, remove content, assist law enforcement in the prosecution of criminal liability, or assert a civil or criminal legal action with respect to content or use of the mobile applications or other services that snapmob.io reasonably believes is or might be in violation of these terms and conditions, but failure or delay in taking such actions does not constitute a waiver of its rights to enforce these terms and conditions.

  • Acceptable use/content requirements

    Please keep the following in mind when submitting photos and videos through the application: to conduct a photo sale, you must be at least 18 years of age; any users under the age of 18 must request access to use the app via email at info@ snapmob.io attention under 18 payment policy must be the copyright holder or have permission of the subject of which you will sale photos; snapmob.io is not responsible for photos taken and sold with subjects permission unless advised to do so by the appropriate party in user s discretion, do not sale photographs the user knows to be confidential or private in nature; do not trespass or enter into any location or sale unlawfully without the express permission of the requestor, or with agreement of owners of private property accessibility and termination. We may change or discontinue any of our services and are not a storage website or service, any information if the service would be terminated will not be stored or maintained. in any case snapmob.io proves you have violated any terms and conditions or any document part of the agreement starred in such document, it will have the right to close the account without prior notice. Copyrights snapmob.io and white village digital company abides all intellectual property laws and rights of others. any user of any kind be it member or nonmember agrees to not violate any copyright snapmob.io and white village digital company, other users or third parties. in case any infringement were to happen, the affected user will file a claim through contact us, which snapmob.io and white village digital company will investigate and resolve in a maximum of 30 days, limited to taking down or deleting the material object of the claim. Governing law by agreeing to the terms, you agree that you are required to resolve any claim that you may have against snapmob.io and white village digital companyon an individual basis in arbitration, as set forth in this arbitration agreement. any controversy or conflict between the parties directly or indirectly related to this agreement, including its nature, interpretation, compliance, execution or termination thereof, will be resolved through the arbitration procedure, in accordance with the rules of the center for conciliation and arbitration of the chamber of commerce and industry of tegucigalpa. In the event that any of the parties appeals for nullity against the arbitral sentence made by the respective arbitrators, such appeal shall be process and decide by a new arbitration that will be appointed and installed in accordance with the provisions of the rules of the center for conciliation and arbitration of the chamber of commerce and industry of tegucigalpa and the law of conciliation and arbitration of honduras. The arbitrators will only have jurisdiction to know of such appeal and shall be constituted solely to hear the appeal for annulment filed.

  • Disclaimers;

    Limitation of liability; indemnity.the services are provided as available and presented in these terms and conditions. snapmob.io and white village digital company disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these terms; also snapmob.io and white village digital company makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of the services or any services or goods requested through the use of the services, or that the services will be uninterrupted or error free. Finally, you agree that the entire risk arising out of your use of the services, and any service or good requested in connection therewith, remains solely with you, to the maximum extent permitted under applicable law. snapmob.io and white village digital company shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the services, regardless of the negligence of any user.
